Finally! Some rain for Lakeway. Early morning wake up call with thunder and lightning - we received about an inch so far this morning with more on the way. So far no severe storms. Stay inside when the thunder and lightning comes and be safe!
Legislative Update:
We may have dodged the bullet on Bill SB 451 and HB 2551 addressing Short Term Rentals.They appear to be still in committee with a very small chance they could move to the floor.
The texting while driving bill has made it through the House and Senate and is on it's way to the Governor. for signature - we will see soon if he will sign or veto it. We need this law Governor!
SB 2 is scheduled to be debated on the floor of the House. It adds some new requirements to the city concerning "rollback" rates on property taxes. The current bill invokes more regulations if the "rollback" rate is 8% higher than the last years taxes. This could all change on the floor but I think it would have to be agreed to by the Senate.
The Groundwater District Bill the City is included in appears to be headed for approval by both the House and Senate. It includes the City in groundwater legislation as required by state law. It has no taxing authority so it will have minimal impact.

Council met in regular session Monday evening - here is that agenda. Since there was a large group of citizens wishing to speak I moved citizens participation up right after the Financial Report. Since a significant portion of the speakers were speaking about me I turned the meeting over to Mayor Pro Tem Dwight Haley for that portion of the meeting. He did a great job of keeping the meeting civil.
After citizens participation we were able to canvass the election reports - there was some question as to whether that would happen because the County wasn't scheduled to produce the canvass reports until Wednesday the 17th. We appreciate their efforts and were able to pick up the official reports at 5 p.m. Monday.
Bridge Bertram and Ron Massa were re-elected to Council for 3 year terms - congratulations to both of you! Council Member Bertram nominated Ron Massa for Mayor Pro Tem for the 2017-2018 term. Council Member Massa accepted the nomination and was elected Mayor Pro Tem by a unanimous vote.
The Police Station Bond passed by the close margin of 9 votes. We had a presentation by Jennifer Douglas of Specialized Public Finance (our bonding company) about the process to prepare offering documents for General Obligation Bonds, Series 2017.
Item 10 was a request for a Special Use Permit for a Short Term Rental for a property at 103 Triton. Because of a legal issue this was tabled until the next meeting. The current ordinance restricts issuance of a SUP if there are deed restrictions against that use. More as the attorneys work this out.
A Preliminary Plan was approved for Whippoorwill Business Park on Whippoorwill between Pheasant Lane and Nightingale - the applicant expects this to be offices.
12 and 13 were a plat and re-plat of property in the Highlands.
Item 14 was an approval to award the contract for the Hurst Creek Road overlay project to Lone Star Paving as low bidder at $291,000.79.

Flint Rock Road Update:
Flintrock Trace and old Flint Rock Road Intersection will close on Monday, May 22 after the morning traffic period to complete the last phase of work. Here is a link to more info.
A request for recount of the Police Bond election was filed by Tiffany McMillan represented by attorney Bill Aleshire. That recount will be held on Monday at 10a.m. per state law. Steve Jones and I have been working with the County and city attorneys and the Secretary of State to assure we are following all rules and regulations pertaining to a recount. I have appointed a committee and all seems to be in order at this point. I expect no changes to the count of votes, the County is good at their job and I have no reason to expect a change. Two things can happen - the vote count will be the same and the 30 day waiting period will go forward from the original date of canvass (Monday May 15). If there is a difference we will canvass again on Wednesday and the 30 day waiting period will start then. More as I find out.

Lakeway Activity Center to host acclaimed pianist. Kiyoshi Tamagawa will return to the Lakeway Activity Center at 4 p.m. June 11. Mark your calendars, this is a free performance.
June 12 is the date for the next Big Band Bash at the Activity Center. Another free event, a large dance floor and air conditioning - what more could you ask for?
Pedernales Electric Coop will be replacing hundreds of transformers in Lakeway. They are improving their distribution system and will increase system voltage. More as the schedule gets closer.
May 26, 11 a.m. we will have the annual Memorial Day service with guest speaker Rear Admiral Judson USN, Retired. Hope to see you there!

LPD Officers conducted 168 traffic stops, responded to 24 alarm calls, responded to 23 animal calls, answered 24 suspicious circumstances calls, responded to 5 collisions and handled 130 other types of calls for service for a total of 374.
Routine traffic stops resulted in the following charges; Out of Jurisdiction Warrant X 1, Possession of Drug Paraphernalia X 2, Possession of a Controlled Substance X 1, and Driving while Intoxicated X 1.
Officers responded to a Lomita Drive address to assist Travis County Deputies with a disturbance call. Upon arrival it was discovered that one of the persons involved in the disturbance was having mental issues. One of the Lakeway officers on scene was familiar with the subject and was able to calm him down. After completing an evaluation, the officer issued an Officer’s Emergency Detention Order. The subject was transported to Baylor, Scott & White for treatment.
Animal Protection Officer Greig responded to a Tellus Street address in reference to two dogs at large. She was able to locate and capture both dogs. The officer recognized the dogs and was able to leave a message for the owner that the dogs were in the department kennel. The owner picked up the dogs later the same day after paying the impound fee.
Officers responded to a Fantail Loop address in reference to a disturbance call. Upon arrival officers found that an elderly subject had been assaulted by a family member. One person was arrested for the assault and transported to the Travis County Jail.
Officers responded to a local hotel for a disturbance call. Upon arrival officers made contact with a subject who was running from the hotel across the parking lot. Officers learned that hotel security had been in contact with the subject and were attempting to stop him. The subject was placed under arrest for public intoxication and transported to the Travis County Jail.
Detectives were assigned to investigate a report of an Assault that occurred at Lake Travis Middle School. According to the complainant, his son was assaulted by another juvenile classmate. Detectives have interviewed multiple parties involved and the case remains active.
Detectives were assigned to investigate a report of Criminal Mischief that occurred at a local restaurant. According to the complainant, his vehicle was intentionally struck by another vehicle while in the drive-thru lane, causing minor damage. Detectives are collecting evidence and statements in the case which remains active.
Detectives were assigned to investigate a report of Criminal Mischief that occurred in the parking lot of the Lakeway Resort and Spa. According to the complainant, he noticed minor scratches on his vehicle after leaving it parked in the valet area. Detectives were unable to find any evidence to suggest this was a criminal act, therefore the case was closed as unfounded (civil matter).
Detectives were assigned to investigate a report of Identity Theft that occurred in the 300 block of Tellus. According to the victim, his identity was used to send a wire transfer to Africa. The victim also reported that his ex-girlfriend was possibly accessing his cell phone accounts without his authorization. Detectives are attempting to obtain evidence in the case which remains active.
Sgt. Brown presented the Alcohol Tobacco & Other Drugs Course to the 5th grade classes at Lake Pointe Elementary School.
APO Greig investigated an Animal Attack that occurred in the 100 block of Snapper. According to the victim, a neighbor’s dog bit her, causing minor injuries. Although the victim declined to prosecute the owner for the attack, the owner was cited for COV – Dog at Large.
The Lakeway Citizen’s Police Academy graduation was held on May 11 at the Lakeway Activity Center. Chief Radford was on hand to present the certificates to forty-four graduates. The event was attended by family and friends as well as members of the police department staff. Local dignitaries in attendance included Mayor Bain, Council Members Jean Hennagin and Bridge Bertram. Congratulations to class #14.
