Council met in regular session and here's what happened:
Looks like our finances are in good shape per the treasurer, Al Tyson. We are well under budget so far and revenues are holding strong - GREAT work staff!
The Council voted to adopt the proposed amendments to the Building Ordinance. There were several clean up issues and changes, including project completion schedules, accessory structures, property maintenance, guardrails, deed restrictions, screening, solar energy, driveways, landscaping, fencing, and inspections.
The Council went into Executive Session to discuss our city's authority to regulate marina development in our ETJ. No decisions were made and advice was solicited from council to help the members with decisions in the future.
After returning from Executive session, Council heard from residents on the issue of the marina project at Graveyard Point.
Council approved the consent agenda which included approval of Council minutes, an amendment to the City's Personnel Policies and Procedres Manual and Tom Brewer's appointment to the Lakeway MUD Citizens Advisory Committee.

Weekly Update +
Several items of interest this week. At the November Council meeting, council voted to nominate Michael Murphy to represent the Western District of the Travis Central Appraisal District. He lost the election to Tom Buckle. I'm sure Tom will well represent the citizens of Lakeway!
A Board of Adjustment meeting was scheduled to meet Wednesday to act on a variance request from an applicant that wanted to bring in an aircraft to the local Airpark that exceeded the size specified by city ordinance. The meeting was canceled when the applicant withdrew his application.

The City is interviewing applicants for Finance Director. Hopefully there will be an appointment before Council at the January meeting.
There was a meeting of the Deer Management Committee and Kevin Schwausch, Big Game Specialist for Texas Parks and Wildlife attended. He confirmed that TP&W considers our deer
management program to be one of the most effective in Texas.
Tonight the Police Officers Association sponsored a party for the Lakeway Police Officers and their families. It was well attended and we are looking to make this an annual affair!

The City was advised Thursday that Richard Eason, General Manager of Lakeway MUD, has been placed on administrative leave by Tom Rogers. An early press release said that Eason's continued employment will be put to a vote at the District's January board meeting. Rogers was quoted as saying that Eason betrayed a confidence and his actions are inexcusable.
More on this in the near future I'm sure!

Volunteer of the Year and Lifetime Volunteer Achievement Award
The 2009 Lakeway Volunteer of the Year was awarded to Janet Wright at the volunteer recognition party on December 4th. Janet has served on the Parks & Recreation Commission, the Activity Center Advisory Committee and most recently she has dedicated her time to Arts and Beautification Committee.
Since 2005, she has been Chairperson of the Arts and Beautification Committee and developed several programs including:
The Brown Bag Concerts
Sunday Afternoon Concerts
Evening Concerts
Parkfest
Public Arts Program and the Photo Festival.
She worked tirelessly on the new wall and plantings along Lohmans Crossing at City Hall, the Sculptures in the median on Lakeway Boulevard and most recently the Lakeway Entrance Monument on 620.
Janet is also a Board member of Tex-Arts, an association for the visual and performing arts, and the Lakeway coordinator for Operation Interdependence, a civilian to military delivery system supporting our deployed military personnel. She is the sole proprietor of her own architecture-rendering & design company. She belongs to the Lake Travis Arts league, the Capitol Arts Society and the Waterloo Watercolor group.

Weekly Update
Hi everyone! This one's a little late. I hope all the kids went to Breakfast With Santa yesterday! I was in the back busy printing pictures of those that visited with the REAL Santa - yup, we had the real Santa there! Thanks to everyone that made it happen!
For the real news! TxDot awarded the project to do the intersection improvements at SH 71 and Serene Hills Drive to Capital Excavation. The project will probably start in late January or early February. I'll share the actual schedule as soon as it is available.
After ZAPCO again turned down the Special Use Application for Speedy Stop, they are withdrawing their application. This officially means this project is dead.
The Charter Review Committee is working toward a recommendation to the City Council for proposed changes to the city charter. It is not finalized at this time but it looks like there will be several changes. The plan is to have it to the council in February so it can be on the ballot in the May election.
Ramming Paving completed one day of a three day crack sealing contract that involved putting sealer in almost four miles of cracks located mostly on Lohman's Crossing between the fire station and Hurst Creek. This doesn't look real good but is necessary to help extend the life of the pavement. We are working on plans and a cost estimate for reconstruction of the road in this area.
The City continues to monitor the failure on Rough Hollow Rd. The developer has an engineered restoration plan and intends to start construction as soon as possible. More as this saga continues!
Chief Radford has promoted Benny Reid from Dispatch Supervisor to a newly created position of Police Manager. He will supervise and administer most of the civilian functions of the department including dispatch and the investigations division. Chief Radford thinks this is a great fit and we are looking forward to further utilizing his skills!
The police department is preparing to hire two new officers, our new patrol car is inn and we are waiting on a new patrol truck.

Weekly Update
Not a lot to report, but there are a few things of interest. As previously posted, Rough Hollow Drive is getting worse. It is currently open, but the City is watching closely and if it gets worse, it will have to be closed until restoration is finished. We don't want anyone hurt!
The Special Use permit for a Speedy Stop at the old Exxon location was denied, mostly because of congestion concerns. We don't know if it will be brought to the City Council at this point - updates as they come up.
Activity in the permitting department is picking up. It's not a global recovery but it appears there is interest in the building industry in Lakeway!
The police department has four candidates in the background stage of the hiring process. With luck, we may have new officers by the end of the month!
For those interested, the Flippers Pet Store animal abuse case is over. Mr Courts was found guilty and was fined, given community service, and may not own another pet store.
The Lights On program was a GREAT success! Our own "Trail of Lights" is really looking good and is still FREE. Walk through and see what you think!
The City is installing street lights on RR620 at Stewart Road and Flamingo Road. This was done at the request of area residents and in the hope it will add to the safety of in both of these areas.

ZAPCO / Rough hollow Road
ZAPCO met this morning and voted to NOT recommend a Special Use Permit for a Speedy Stop at the old Exxon location. They felt traffic congestion, property values of neighbors and public opinion were justification to deny the request. Speedy Stop has the choice now of dropping the issue or taking it to the City Council.
Rough Hollow Road has been re-opened and will stay that way for a while. The developer is looking for solutions and the City is monitoring the situation to be sure the roadway is safe.

Lights On, Rough Hollow Rd., Highlands Blvd.
Hi again folks! Did you know we have the REAL Santa Claus? We do! He was at the Activity Center last night with Mrs. Claus making their list and getting orders from all the kids! It was a GREAT show and all of the entertainers were awesome!
Rough Hollow Drive is getting worse and was closed this morning. As you can see in the pictures the whole side of the hill is collapsing. The developer is looking at solutions now - I expect the road will eventually be closed, so you will have to access this area via the north end of Rough Hollow Road. Watch the city website for instructions for a detour.
They are also working on Highlands Blvd. As you can see, they are building a wall to protect the road. This is a large project and the rainy weather is not helping the construction progress. I haven't heard a projected date yet but will keep my ears open and will post it when I hear something.

The Developer is working on Highlands Blvd. and is working on retaining walls where there were problems after the rains started. It will still be a while before it opens.

Week in Review
Chief Todd Radford speaking to the Lakeway Citizens Police Academy Alumni Association on Wednesday night. There were about 25 folks present. This organization was formed by graduates of the Citizens Police Academy that Detective Mary Proctor puts on every year. Watch for notice a new class is forming!
The intersection project at SH 71 and Serene Hills Road is being bid out by TxDot and is on schedule to be awarded to a contractor in December. That means the work should at least get underway in the first quarter of 2010.
TCEQ soundly rejected the petition for Granite Shoals and Leander to abolish the "no discharge" rule for the Highland Lakes. It appears they are not interested in any change to the rules.
Deer trapping has begun and so far 27 deer have been trapped this season. We may not reach our estimated 125 this year - maybe the population has been reduced to a more manageable number (maybe the deer are getting smarter!).
The 18 year old man that was involved in the collision on 620 last Saturday has been charged with criminally negligent homicide. He has no drivers license and has family in Mexico, Judge Madison considered him a high flight risk and set his bail at $250,000.
Lake Travis Fire and Rescue will be remodeling and renovating the Lohmans Crossing fire station. While the work is proceeding there will be portable buildings in front of the station for the firefighters. Expected completion and removal of the temporary buildings is before April 1, 2010.
The CBC denied the request for a variance in the height of a Holiday Inn Thursday. It appears that the developer is now planning to reduce the height by digging into the hill side and possibly reducing the pitch of the roof to meet the 32' limit. They will go before ZAPCO and the City Council to try to get the zoning changed from C-1 to Hotel / Motel.
There is a significant road failure on Rough Hollow Drive just South of Canyon Turn Trail. As you can see, the ground under the road has collapsed and is falling away. This seems to be a major issue and may take some time to correct.
A contractor has been working on Lohmans Crossing at Lohmans Spur to install a French Drain that will hopefully correct the problem with water standing on the road.
Don't forget the Trail of Lights program on November 30th in the Activity Center Parking Lot! It promises to be a big hit with the kids!

Chief Reception, Council Results
The new Chief, Todd Radford, had a GREAT reception last evening at the Activity Center. Volunteers from the Lakeway Citizens Police Academy Alumni furnished labor and refreshments for the event. Chief Radford gave a short speech and everyone had the opportunity to meet him and his family. It was an exceptional event!
After the reception Council met with the following results:
The Council approved the employment agreement with Chief Radford. After that vote was recorded, he was administered the Oath of Office by Christy Fath, City Secretary.
TexArts made a presentation to the Council and audience about their involvement and successes in the Arts in the Lakeway Area. After the presentation, there was some discussion on ways the City can support TexArts and their future plans.
A zoning change was made to the Marina Village PUD to allow an additional 3 feet for one building to enable enhanced access capabilities.
The Council voted 5-2 to waive the City fees for a benefit home built by Zbranek Custom Homes where the profits are to be donated to the Lake Travis Youth Association. The association was defrauded of nearly $200,000 last year by a credit card collection company.
An amendment was approved to the Code of Ethics Ordinance requiring more of the City employees to sign the Code of Ethics document.
The Council vote to pursue funding through the Energy Efficiency and Conservation Block Grant. This will allow funds from the Stimulus funds to be spent to do an energy audit and improve the City's energy efficiency with monies form the Grant.

Weekly Update ++
Hi folks! The City is working to fill the open positions we have as quickly as possible. Welcome Crystal Gill as our new police dispatcher! We have applicants for court clerk and the two open police officer positions. We are also starting our search for Finance Director.
Staff met with IESI this week to discuss our recycling program. They think there are opportunities to significantly improve the service. We should have a more definitive proposal from IESI in the next few weeks for consideration.
It appears we are responding to a lot of false alarm calls. The City is looking at an ordinance to charge a graduated fee for responding to false alarms.
The Holiday Inn Express developers will be back again to the CBC for another hearing on additional height. They have repositioned the building and will only need 6 additional feet now. The CBC meeting will only address the height issue, so please limit any comments to that issue. Council will address the zoning change depending on the results of the CBC decision, possibly in December.
It looks like Speedy Stop will make another run at ZAPCO for a special use permit for the Exxon location. they have addressed many issues and I'm sure it will be an interesting meeting!

Veteran's Day, Blood Drive, Chief Radford's Reception, Council Meeting
If you didn't go to the Veterans Day celebration at Heritage Park - you missed a GREAT function! The Police Color Guard did a great job of handling the flag duties! Many thanks! Many veterans were present and were honored by the crowd.
Mayor DeOme welcomed the crowd!
Duane Zimmerman placed the Wreath at the monument before the crowd was led in singing God Bless America by Melanie Morrison who was accompanied by several Lake Travis ISD students.

Weekly Update +
Hi everyone! Another week has passed already - here's some news.
Time Warner is raising our rates - they notified the city and notices will be in the paper and here is a link to the notice sent to the City. Time Warner
Councilmember Alan Tye has furnished a "white paper" from LCRA about the current and continued drought conditions. Here is a link to that report. LCRA Drought White Paper
The Holiday Inn has revised their plans for an Express at RR 620 and Oak Grove Blvd. They moved the building farther for residents and removed the windows from that side of the building. They will still need a variance for the height and will also need a zoning change from Commerical to Hotel / Motel.
Crosswater Yacht Club marina has completed a traffic impact analysis and will make a presentation at this months Council meeting. They hope to convince the City that a marina will not have a deleterious effect.
Council will not take up a no-smoking ordinance until after the first of the year. The December meeting will be on December 21st which is the normal scheduled date.
Staff met this week with the Developer of Rough Hollow to discuss the status of Highlands Blvd. They will be stabilizing the slopes with a slanted "Tillman" wall and will be installing more landscaping. Repairs and landscaping will take six to eight weeks and the road will not open until all is finished and accepted.
In case you didn't see the View or news, one of our officers, Steve Adams, was assaulted during an altercation at the Chicken express last week. He was intervening in a domestic issue and was attempting to make an arrest. He received only minor injuries and is doing well. The perpetrator was arrested and last I heard was jailed with a $75K bond. He is / was an employee of the restaurant.

Highlands Blvd., Serene Hills
Lots of questions about the status of our new roads. Highlands Blvd. was expected to open a while ago and was delayed because of issues with the cuts that were made through some of the hills and stabilization of those cuts. All was looking good until the rains finally came and there were issues with the cuts sluffing off from the rainfall and drainage. Currently the developer is preparing a plan to address the issues. I don't expect opening for at least a month or two. We need this done right so eventually the city can maintain it economically.
Serene Hills Blvd. is another issue altogether. It won't be opened until the traffic controls are completed and operational on Hwy. 71. The money has been made available and currently TXDOT is in the bid process for the project. Once the bids are in and one is selected we will have a tentative date for completion. Don't expect this until 2nd or 3rd quarter next year.
That's the story so far - more as I find out!

Whataburger / Hospital / Holiday Inn Express / Speedy Stop
You have probably noticed that Whataburger is closed. They are changing their driveway to share with the Motel behind them to reduce the number of entrances. They had an issue with a grease trap that has been repaired and are hoping to re-open by the end of the week.
The hospital project is still moving, although slowly. They reportedly have their HUD financing guarantee done and are continuing to move forward on the project. I have seen the gate open and individuals working or looking so hopefully it will start moving forward shortly.
The Holiday Inn Express that is looking to build at 620 and Oak Grove was turned down for a variance that would allow them to add 10' height to the 32' limit for commercial buildings in Lakeway. They are revisiting the plan and are changing the position of the building in hope that it will solve the issues and will be before the CBC again in the near future.
Speedy Stop is revising their plans to see if they can change their plans to better suit the area. Currently they are not on the ZAPCO schedule so I expect it will be at least December.
More as I learn of it!

Weekly Update +
There are several items of interest for the week so let's get started!
Nancy Klingman, Finance Director, is resigning effective November 10 to accept a position of Finance Director for the Village of Ruidoso, New Mexico. We wish Nancy all the best in her new position and will miss her knowledge.
Looks like there is interest in considering a "no Smoking" ordinance so look for it on future agendas. Currently there are 3 establishments I am aware of that allow smoking in the City limits.
Travis County joined the City in passing a resolution in opposition to lifting the wastewater effluent discharge ban on the Highland Lakes. We welcome their support and I will keep you updated as this issue evolves.
PEC sponsored a workshop about he Federal Energy Efficiency and Conservation Block Grant Program and our Deputy City Manager Chessie Blanchard represented us at the meeting. It appears we are initially eligible for about $50,000. If everything works out, we will use the money for energy audits of City buildings and to replace the HVAC system at the Activity Center. GREAT!
David Ferry's department aerated and seeded Lakeway Blvd with perennial ryegrass seed. They also replaced the irrigation controllers that seem to have a mind of their own on Lohman's Crossing. They are also preparing for the lights and decorations for the holiday season.
If you remember a while back I talked a little about the reverse 911 that was used to notify residents when the jewelry store was robbed and fugitives were on the loose. This can be set up to notify you on your cell phone and I am attaching instruction for that if your interested. Emergency Notification System
From Andra Streety: Jessica Blair is now the Swim Center Manager and her organizational skills will be put to good use there! Kristen Cole is now the Events Coordinator at the Activity Center. Dallas Gorman is now the Programs Coordinator, scheduling all programs and classes through the Activity Center. Justin Wright is now a full=time Operator II under Parks Maintenance.
goblin Glow was a HUGE hit! About 1500 people attended, there was 5 hot air balloons, face painters, balloon artists, stilt walkers, food and live music featuring the Gary Lee Cox Band. Looks like it's set up for next year already! GOOD JOB!
Veteran's Day event will be on Wednesday, November 11th at 11:00AM at the Heritage Center. The Lights On / Trail of Lights will be held Monday, Nov. 30th in the Activity Center Parking lot and the REAL Santa Claus will be there again this year!
Don't forget to vote! There are several Constitutional amendments and a property tax increase for the LTISD on the ballot. If you don't vote, you can't complain!

Weekly Update, etc.
Another week has raced by! We got more much needed rain and I hear the lake is going to rise around 7 feet - another 40 and the drought will be over! That said, the weather was GREAT today and looks good until Sunday. I'm a little behind on the blog because my Aunt fell and has been in the hospital - we are bringing her home tomorrow and hopefully things will settle down an get back to normal.
Please welcome Todd Radford as our new Police Chief. He was appointed / approved at the Council Meeting Monday. I feel he will be a great fit for the job and look forward to working with him for a long time.
As far as I know the new hospital is moving forward. It appears the HUD guarantee was approved and financing is forthcoming. I am looking forward to seeing dirt moving there soon!
We closed fiscal year with a budget surplus. Our revenue dropped by $272,346 and we were able to reduce expenses by $389,619 for a surplus of $127,263. We were able to maintain a net year end balance of $1,808,247 which gives us a 25% fund ratio balance - this is GOOD.
A letter has been drawn up to the Texas Commission on Environmental Quality that will be sent along with a resolution approved by the Council opposing the proposed lifting of the ban on waste water effluent discharge into the Highland Lakes.
You might have seen a report of a mountain lion attack on a deer in the Hills. Our Animal Control is investigation this with Texas Parks and Wildlife and they have found no evidence of a mountain lion. This has happened before and turned out to be an isolated dog attack. TP&W said that mountain lions pose no real threat to humans - however in the unlikely event that someone actually sees a real mountain lion, TP&W would appreciate a phone call - go figure.......
I was lucky to be invited to the Viewpoints presentation last week and the Austin Symphony conductor Peter Bay spoke to the group. He was a great speaker and was very informative. It was a great evening and if you weren't aware of the group I suggest you check it out! I think it's full or nearly so for this year but plan on it in the next season!
I get questions all the time on the Exxon station replacement. Speedy Stop is still working toward their plan but it will need to go before ZAPCO before the Council and the soonest that can happen is next month - if there is more info I will pass it on. The City Building Commission (CBC) acted on a variance request to allow a Holiday Inn Express to go 10' above the current height limitation for a commercial building. This was denied last Thursday.

Council Results - October / Goblin Glow
We had a good meeting Monday night - a small crowd attended.
The first action item was to Approve Todd Radford as Chief of Police and the Council voted unamimously in favor of this. Congratulations to Lt. Radford! There will be an official swearing in ceremony in the near future.
Rudy Farwagi, District Coordinator of the PEC gave their Quarterly Update and presented a franchise check to the City for $68,018. They also put out some of the new florescent light globes for attendees to pick up - see there is a good reason to go to Council meetings!
Our Treasurer, Al Tyson gave the Financial Report. It appears we are doing well financially because of the hard work the department heads and their staff are doing to curtail expenses. Thanks to all those helping during these challenging times!
The Mayor made a Proclamation naming this week Chamber of Commerce Week. The Chamber works hard to improve the economic issues in the City and surrounding areas.
We adopted a Resolution opposing any change to the TCEQ rule prohibiting the discharge of treated effluent into the Highland Lakes.
Council voted to approve an interlocal agreement with Travis County providing for emergency services within the City of Lakeway.
Council approved a change to the Tuscan Village PUD clarifying maximum residential occupancies.
The golf cart ordinance was discussed again and was sent back for more revision.
And finally the Solid Waste Collection Ordinance was revised to include a deposit for new customers and corrections were made to the fee schedule.

The Goblin Glow was a HUGE success! The weather was perfect for the balloons and trick or treat festivities and I understand about 125 stayed for the movie. GREAT job!
It looks like customers of Pedernales Electric will receive bill credits depending on their Capital Credits account on their November bill. Watch you mail for more information on this!
I am trying to get a status on the Hospital construction or lack there of. The original reason for the work stoppage was re-engineering the electrical design and I have heard that is complete (a couple of weeks ago). I will issue a special post if I get some new intel.

Police Chief, Council Monday, Weeks End
Friday morning the Council met in Special Session and went into Executive Session to interview Todd Radford for the position of Police Chief to replace Gordon Bowers. After the Executive Session, Council re-convened and gave Steve Jones the thumbs up to offer Lt. Radford the job.
Monday will be the next regular meeting of the City Council at 6:30PM. Several items of interest are on the agenda. Following are some of the items Council will be asked to vote on:
Approve the City Manager's appointment of Todd Radford as Chief of Police.
Adopting a Resolution opposing any change to the Texas Commission on Environmental Quality rule prohibition the discharge of treated effluent into the Highland Lakes.

Highlands Blvd., Fall Festival, Goblin Glow
Highlands Blvd. was tentatively scheduled to open this week but has been put off again. As you can see on the pictures, the vertical walls are sluffing off and are not acceptable. The developer is working on a solution! Click on the pictures for a larger view.
You might have noticed several police vehicles, fire department folks and the LCRA at the Lakeway Church parking lot in the mornings. This is the Fall Festival that is put on every year to introduce the different entities to the younger folks. Looks like they had a GREAT time!
The Goblin Glow is here again! Saturday, October 17th, hot air balloons will light up the night sky at the Lakeway City Park for Goblin Glow from 6:30-8PM. City Sponsored Financial Seminar? / Officer Arrested / Special Session of Council
Items of interest:
Did you get an invitation to a financial seminar at the Activity Center that is sponsored by the City? Don't believe it! There is a financial seminar, however there is no city sponsorship. The promoters have been told to send a follow-up letter to all invitees retracting the city sponsorship part.
Officer Deena Dorrheim-Maxwell has been cited for allegedly leaving an Austin HEB store without paying for some groceries. She is currently on administrative leave pending an internal investigation. There is a story reported on KXAN.com. kxan story

Did you get an invitation to a financial seminar at the Activity Center that is sponsored by the City? Don't believe it! There is a financial seminar, however there is no city sponsorship. The promoters have been told to send a follow-up letter to all invitees retracting the city sponsorship part.
Officer Deena Dorrheim-Maxwell has been cited for allegedly leaving an Austin HEB store without paying for some groceries. She is currently on administrative leave pending an internal investigation. There is a story reported on KXAN.com. kxan story

City vs School Tax Rates, Special Council Meeting
Hi everyone! Anyone curious why the city rate went up $.01 per $100 and the cost is $60 per household and the LTISD is wanting $.02 per $100 and the cost is still $60 per household? I did and here's what I found out.
The city uses a flat home valuation from the Travis County TCAD to bse their calculations on. The school district is using approximately the same valuation but is subtracting 3 adjustments from the value before applying the tax increase. They subtract the 10% cap, the homestead exemption and another exemption of about $15K to come up with a final average valuation of $298,904. So if you don't get one or more of these exemptions, your amount could be higher.
The Council will meet in Special Session Friday, October 16, 2009 and will go into Executive session to work on personnel issues, namely hiring a new Police Chief. I am attaching the Agenda

ZAPCO and CBC Meetings
Hi Everyone!
I was unable to attend the ZAPCO and CBC meetings this week but was able to get updates as follows:
First ZAPCO - Meeting Wednesday 10-7-09 at 9:10AM
National Association of the Remodeling Industry will be permitted to put up temporary directional signs for the 7th Annual show - home is located at 108 Chestnut Hill Cove.
Multi-Tenant Monument Sign was permitted at 401 RR 620 North
Sign modification approved for Lakeway Cafe' and Bakery - 325 RR 620 South.
A Temporary Sign Extension was approved for 12 months at The Boulevard (2400 Lakeway Boulevard)
Larry Niemann was given a variance allowing fill in excess of 12 feet for property at 620 and Clara Van Trail.
Tuscan Village asked for an amendment to the PUD clarifying maximum occupancies and approval is recommended to the City Council to approve.
The bid draw was the request from TSTJ Corp. to change zoning from R-1 to PUD so they could build a parking lot on the property. Many residents showed up to protest this and the request was tabled. Residents feel that the developer / owner is moving the condo parking issue to a residential area and are not happy about it. More to come on this in the future.

112 Edgewater Cove was given permission to encroach into the 5' side setback for a Pergola on a deck.

Council Special Meeting results
The Lakeway City Council met today at 2PM. After a lengthy recess a separation agreement was reached by Chief Gordon Bowers and the City. Generally it provides for 6 months pay for Chief Bowers and allows him medical benefits for that time. I appreciate his hard work for the City and wish the best for him in future endeavors!
The Council also approved the Budget and approved a tax rate of $0.1929 per $100 evaluation. This is a balanced budget and allows us to add 1 additional police officer to the force.

Weekly Update, Council Agenda +
Several important things are in progress in the City at this time.
One is the budget and tax rate that the Council has been meeting on. The Council will meet, discuss and set the tax rate along with adopting a budget for your City Services at a meeting on Monday. The current proposal is a budget of $8,712,133 and a new tax rate of $0.1929 per $100 valuation. this will be an increase of about $0.01 per $100. There has been a lot of discussion on both of these numbers in the budget meetings. If you have concerns or just want to see the process, come to the meeting Monday. Here's the Agenda
The other Agenda item that has been of interest is the resignation of the Chief of Police, Gordon Bowers. A separation agreement will be considered and voted on at the meeting. Chief Bowers has accomplished much since coming to work for the City of Lakeway and I wish him the best for the future. Agenda
A dear friend, Jimmy Anderson, was in the hospital for surgery this week, and is now home and doing GREAT! I hope his recovery is speedy, it's his turn to drive!
Speaking of Speedy, Speedy Stop has submitted a revised plan for a convenience store at the Exxon site. There are still some concerns and staff is working with the developer to further refine the proposal. It would have to go back to ZAPCO and would then go before City Council. I have not seen the proposal yet and am not sure of the changes.
Crosswater Marina developers are still trying to go forward with that project. They will make a presentation to Council and convey the concessions they will commit to in order to make the project more palatable before the end of the year. There are several other issues including traffic analysis and resolving an ongoing lawsuit regarding alleged violation of deed restrictions. More to come I'm sure.
Because of Oak Wilt issues the City may not have an annual brush collection program this year. Residents will receive a letter outlining the problems. Letter from Forester
Lake Issues: Some cities are requesting that the TCEQ remove the prohibition agtainst releasing treated wastewater into the Highland lakes. This water is relatively free of contaminates but does contain nutrients that act as fertilizer for the production of algae. Council will look at a resolution to keep the prohibition in place at the regular October meeting. Cole Roland will attend to discuss the issue.
As you might have noticed, sprinklers have been turning on at random times on Lakeway Blvd. and Lohmans Crossing. David Ferry has traced the problem to the new solar powered controllers that recently were installed. The manufacturer has acknowledged there is a problem and will replace all of them at no cost to the City.
Judge Madison would like the City to adopt an ordinance against texting while driving on City streets. City Staff will be looking at the feasibility of that in the future.
Councilmember Dennis Wallace is working with Roland Pena (LCRA) and Andra Streety to see if we have any projects that qualify for a grant program that LCRA has to fund park related projects. GREAT idea Dennis!

Weekly Update
Here's the week at a glance!
The City Building Commission met on Thursday, Sept 24th. They approved a variance into the front 25' setback on Capri. With the topography, the fence will not be very visible and it didn't make sense to split the yard. A structure at 107 Javelin was determined to be a screening structure and was permitted with the addition of plantings covering a percentage of the structure. A waiver was expanded at 414 Sunfish to allow siding on a remodel. They inspected several homes for a final Certificate of Occupancy.
The budget was further massaged and revisions have been made for the Budget Meeting / Work Session that will convene on Monday at 2PM.
Former Warrant Officer Deena Dorrheim-Maxwell has returned to work for the City as a part-time Warrant Officer on a temporary basis. Judge Madison and Chief Bowers believe the position can generate enough revenue to pay for the cost of this position. There will be a revenue-expense analysis done 90 days out and if it is positive, City Manager Jones will consider recommending unfreezing the permanent position.
Judge Madison (Municipal Court Judge) is considering running for Justice of the Peace, Hays County Precinct 4. He has indicated that he intends to continue working with us as municipal Court Judge.
As indicated earlier, there is a Budget Meeting / Work Session scheduled for Monday, September 28th at 2PM Agenda. There will be another meeting on October 5th to adopt the final budget and City tax rate.

Council Update
Here's an update on the results of tonight's Council meeting:
Mayor DeOme reported that Saturday's blood drive was very successful with 79 units of blood collected. Thanks to the residents for supporting this important volunteer effort!
During Citizens Participation, Karl Ansbach made a presentation asking the City Council to pass a smoking ordinance for the City of Lakeway. He mentioned that previous Councils had not been able to get an ordinance through and he felt it was important not only for the residents but for employees of area businesses.
Mayor DeOme made a Proclamation designating October 6, 2009 as "National Night Out" in the City of Lakeway.
There was discussion of the General Fund Budget and a hearing on the Proposed Property Tax rate. There was no public comment on these issues.
The Council approved an interlocal agreement with the City of Bee Caves for police dispatching and communication services. Motion was passed unanimously.
There was a lengthy discussion of adopting an ordinance relating to the operation of golf carts. Council charged the staff to come up with suggestions. There are many safety concerns and discussion also centered on restrictions, especially requiring a drivers license.
There was a discussion of amending the Solid Waste Collection Ordinance. This was tabled and sent back with several suggestions for staff to investigate.
All consent agenda items were passed unanimously.

Weekly Update ++
Highlands Blvd. is still under construction - mostly retaining walls and landscaping. The City is waiting for a call from the developer for a final inspection and walk through before it can be opened. The rain had delayed the construction and completion could still be a few weeks off.
It appears Carrie Burns (forester) has discovered a strong correlation between the citywide brush programs and the spread of oak wilt. The city may look into rethinking the brush pickup program.
The Charter Review Committee had their first meeting this week. Steve Swan was elected chairman and the committee is soliciting comments and recommendations for possible amendments to the charter. Steve Swan can be reached at Steve Swan .
The Developers of Crosswater Yacht Club have been invited to the October Council Meeting to give a presentation on their project and tell us what they are willing to do to mitigate the city's concerns. This will start a dialogue for further communication with the developers.

Blood Drive / LTYA Benefit Houst

Armed robbery / Speedy Stop / Lake Cleanup Results
Today was much slower than yesterday - give our police a big hand for catching the 3 individuals that attempted to rob Cristiani's Jewelry! Turns out they were armed and we found the gun. One of the folks in the store was injured but was treated on scene and is doing fine. A lot of work and effort but it culminated in success! Thanks again!
I have been told that a vote on the Speedy Stop will be delayed until the October Council meeting. Any major changes will have to go before ZAPCO before going to Council.
The Lake Travis cleanup was a huge success! They removed 10 TONS of debris from the lake. I am attaching a link to the press release for your enjoyment! Lake Cleanup Press Release

Armed Robbery, Police Chief Bowers Complaint, McCabe Schedule
It's been a busy day! There was an attempted armed robbery at Cristiani's Jewelry today before noon. There were three armed men, one was captured and two are still at large. There was a massive manhunt and Travis County worked with Lakeway PD with the help of off duty police and the EMS helicopter for several hours. The car they used was impounded and was taken in a carjacking yesterday. These men are armed and dangerous so keep your eyes open! The golf course was also closed because of the search.

Neighbors were notified by the "reverse 911" system. It allows city officials to mark off a geographic area and a phone message is delivered to all residents in that area - great system. As far as I know this is the first time it has been used other than for testing.
Most of you know that Police Chief Bowers filed a complaint that resulted in an investigation of the Mayor and Mayor Pro Tem alleging Official Oppression. I am furnishing links to the original letter and the summary of the investigation as part of this blog since Council voted to make it public. Council has advised the Council not to comment on the letter or Investigation so you will have to read the reports and form your own opinion.
Msgr. McCabe's Viewing will begin at 5:00 PM with the Vigil Service at 6:30 PM on Wednesday, Sept. 16. The Mass of Christian Burial will be at 10:30 AM on Thursday, Sept. 17. Msgr. McCabe was 79 years old when he passed away. The services will be at Emmaus Church on Lohmans Crossing.

Weekly Update
Hi everyone!
Of course the big news this week is the rain! Isn't it wonderful! As of today, we have had 8.5 inches of rain at the Airpark - that's correct, 8.5 inches and it looks like we have more to come. It's great!
There was a Council meeting and public work session on 09/10 to discuss the City budget. Currently we are looking at about a $.01 increase over last years tax rate. This would bring us up to a 0.1929 rate.
There are several reasons for the increase, a couple are Building and Development fees are down to about $330K from a high of $1.3 million and our sales tax revenue is down because of the economy. The Staff has done a great job of limiting expenses in various departments and we are looking into trimming expenses even further.
The bottom line is we want to be sure that our safety and quality of life are what we all expect! There will be a Council meeting on 9/21, a public hearing on the budget on 9/28 at 2PM, and another meeting on 10/5 to adopt the budget and tax rate. Come see your City Officials at work!
There is another Council Special Session on September 14th at 2PM to hear the report from the Special Investigator hired because of a letter from Police Chief Bowers. Agenda 9/14/2009

Worker Drowns in Pool
A painter drowned Tuesday evening in a pool in the 400 block of Malabar. Two workers were finishing up their day of work when one of them got into the pool. He was having trouble and the other worker didn't know how to swim and couldn't go in after him. He went to get help but by the time rescuers returned, the man had drowned.

Rain Update
For those of you that received rain last evening, count your lucky stars! On the West side over where I live we got nada, nothing, zip, no rain at all. It thundered, wind blew, etc. but not a drop. I hear the East side got some good moisture.

Weekly Update
The Crosswater Yacht Club and Marina received a stop work order from the City last week. This triggered an issue with the LCRA because their permits are contingent on permits from the City. On the good side of this issue, the area has been cleaned up by the new owners. They appear to be willing to work with the City on several issues including no boat ramp, no restaurant, and no music venues. More to come I'm sure on this in the near future.
ZAPCO voted 6 to 0 to recommend against the Special Use Permit requested by Speedy Stop for the old Exxon location. There were several reasons for this decision including safety concerns because of increased traffic, operation hours, size of the facility, and other considerations. We are not sure if they will bring the issue before the next council meeting - I will let you know!
Emmaus Catholic Church was given a variance to allow construction of a new building. There were two variances and both infractions are minor. The variances were for cut and fill issues and building on a slope in excess of 25%.
You might have seen the City irrigation system running at improper times on Lohmans Crossing and Lakeway Blvd. The City has recently installed new controllers with solar powered units and they seem to have a mind of their own. They should have them fixed soon.
For the Hills folks - I understand one of your Aldermen is turning 80 this month - what a milestone. I won't mention his name but he uses the initials J.R. If you see him say "Happy Birthday".

ZAPCO Meeting Update
Today ZAPCO (Zoning and Planning Commission) met on several sign requests including a variance to the sign ordinance allowing the Grill at Rough Hollow to post a temporary sign near Lakeway Blvd. advertising their new business. All sign requests were agreed to and the variance was allowed.
Speedy Stop requested a Special Use Permit to locate a convenience store where the old Exxon station was located. The Commission decided to recommend against this Permit to the Council for numerous reasons including traffic concerns, hours of operation, size of building, and general fit in the neighborhood. Speedy Stop / Lake Travis Transitional Hospital
A previous post reported in error that the Lake Travis Transitional Hospital had lost their funding. Workers are still there and it looks like construction is proceeding.
Be on the watch for our police motorcycles! I will have pictures soon of our mounted officers. Be safe out there and observe the posted speed limits. We have a GREAT safe community, lets keep it that way!

102 Blue Jay Update / Building at Lakeway Blvd. & Drive
The fire at 102 Blue Jay is still under investigation and very little is being released at this time. Rumor is that it was arson. I'll let you know if anything breaks. They are working on cleaning it up and rebuilding as you can see from the picture - they've been steady at it!
I'm sure most of you have seen the building construction going on at the corner of Lakeway Blvd. and Lakeway Drive. Dr. Robbie Robinson, a long time Lakeway dentist currently at 1200 Lakeway Dr. is building this for his practice and will occupy most of the upstairs. He is currently looking for a tenant for the downstairs.

Hospital Update
As you may know, there are two hospitals under construction in Lakeway. There is the Lake Travis Transitional Hospital that is located behind the post office and the large site on 620.
We are checking on the Transitional Hospital issue - this may have been in error. More to come!
The larger site that most of you are familiar with is at RR 620 and Flintrock and has been in a holding pattern waiting on a redesign of the electrical service from Austin Electric. It seem that since the site and project has grown that they will need more power that originally thought and it is waiting on the new design of the service. I expect that work will resume in the near future.

Weekly Update
Another week is at its close and here's an update.
At the last Council Meeting, we required the folks at Crosswater Marina (in the ETJ down by Graveyard Point) to get permitting from Lakeway before continuing on construction. They were digging holes for anchors and the City stopped construction and posted a stop work order that is still in effect. Work has stopped and they are actually cleaning up the site.
There are plans for a Goodwill Store at 1901 S. RR 620. This is the property at the entrance to The Vistas, across 620 from Glen Heather. This is commercial property ant this type of use is allowed.
It appears that our July sales tax receipts are real close to budget. One month is not a trend but we are optimistic that August will also show improvement. This would be a welcome indication!

They are trying to come up with a standardized agreement to avoid complications when contracting with so many cities.

Oscar Meyer Weiner Mobile
Deer and Humming Birds
A neighbor came over yesterday with a shoe box - inside was a humming bird that was totally worn out and probably near death. These cute little birds get trapped in garages and buildings because their instincts tell them to fly up to escape. This one had worn himself completely out and fell to the ground. We were able to make sugar water available by putting a drop or two right on the end of his beak. Eventually I could feel his tongue licking at my finger. In about 5 minutes he had found enough energy to fly off. Be kind to our little friends!

Weekly Update
Pretty mundane this week - no movie stars that I am aware of!
The LCRA, Travis County and Keep Austin Beautiful will sponsor the 15th Annual Lake Travis Underwater and Shoreline Cleanup on 9/13/09. Janet Caylor, owner of Lakeway Marina, has organized a local Lakeway event to supplement the main affair. This flyer was posted a couple of days ago if you are interested. IESI is donating roll off dumpsters to contain the collected trash - THANKS!
Public Works has been working on clearing cedar trees and has made some good progress this week cleaning it up. New trees will be planted this fall to fill in the open areas.
Mayor DeOme and City Manager Jones met with the new general manager of the Lakeway Resort and discussed general issues. Suggestions were made for parking issues when there are large events. Marketing manager Mike Islava said they were looking for ways to get the Resort more involved with the community.
City Engineer Paul Duncan gave a new rendition of the old Sue's tour at the Men's Breakfast Club Wednesday. If your interested, go to cityoflakeway.org and look for the Development Update Map which is interactive.
Per Richard Eason of Lakeway MUD, the rock work is complete on the Lohman tank, the architectural contractor is starting work and should take about 3 weeks. Looks like it may be finished up by the end of September.
We have a new external defibrillator at the Heritage Center that was purchased and donated by the Lions Club - many thanks!
One of the next major projects is to replace the failing storm water culverts on Rolling Green Drive. Public Works is working on the new irrigation system on Lakeway Blvd. and Lohamn's Crossing. Crosswalk signs were installed on Lakeway Blvd. & Highlands Blvd. and the school zone flashing lights for Lakeway Elementary were reprogrammed. Watch out for the kids next week!

Citizens Police Academy / Lake Cleanup
An Organizational meeting of the Lakeway Citizen's Police Academy Alumni was held this evening at the Justice Center in Lakeway. The new bylaws were voted on and they are moving forward with the association Check with Mary Proctor at the PD for new class schedules!
