I received word tonight that the lawsuit that was filed over the Annexation of Brooks Hollow was dismissed today. The plaintiff has 30 days to appeal.

Council Results, Alive at 25 and More
Council met in regular session Tuesday evening. Here is that agenda.
Our finances are in good shape according to Treasurer Al Tyson. We are below budget on expenses and above budget in revenues - a good way to be!
Council voted to approve the Library District's request to proceed with the issuance of the bonds approved by voters. Once the documents are prepared there will be another vote and the bonds will be sold. Once this occurs, the District will let a contract for the construction of the new building.
After a presentation and much discussion, Council voted to put the sale of part of Rebel Park to residents who own property surrounding the park. The purchase price is $70,000 and will be added to the Parkland fund for future purchases. I for one do not like selling any parkland, however after carefully studying this it appears the land is useless to citizens and this is a good move.
There was a presentation by Phin-Ker Ventures on their ideas for development of the area around the Lakeway Medical Center. There was no action taken on this. My concerns include the traffic issues already in the area and the density of multifamily construction. The plan looks good on paper and we will be looking closely at different parts of the project in the near future.
The Lakeway Highlands Multifamily Tract items were pulled by the developer. There are concerns as to the impact of apartments in the area and Lakeway does not derive much benefit from the project in my opinion.
An amendment to Zoning Code was voted on to prohibit driving across private residential property except on a paved driveway. This was caused by an issue with one resident that accesses his back yard by driving around his home to access a parking area in his back yard. The vote was 6-1 for the amendment. I voted against the amendment for a couple of reasons. I don't think we should make laws because of one person issues. I also know of many folks that occasionally access their yard for various reasons and create no neighbor or lawn degradation issues - they will now have to break the law to do this. Also, there is no reason this individual cannot pave where he is driving and the problem would continue. We will see where this goes.
Council instructed look at another option for noise regulation amendments. Instead of requiring all businesses to have a Special Use Permit if they have outside amplified music, they will look at situations by resident complaints.

I met with Officer Hector Almaguer of the Lakeway Police Department today and he told me about a project he's working on in Lakeway called "Alive at 25". It is a non profit organization that is working to help prevent traffic violations, collisions and fatalities in our youth and young adults in the age group 15 to 25. Statistics show that once they reach 26 years they are much less likely to become a statistic. He is going to do a FREE class on Saturday, February 18 from 9AM until 1:30PM. Here is a link to more information on the program. Please consider getting your kids or grandkids in this one time opportunity! It could save their lives! It can also get them discounts on their auto insurance.
Don't forget, about the 11th Annual LAC Appreciation Breakfast coming up on January 28th. Seatings will be at 8AM and 9:15AM. Please mark your calendars. Council and the City Manager will be cooking bacon and pancakes!

On Tuesday, January 17, 2012 Mayor DeOme reinstated teh Burn Ban for the City of Lakeway in accordance with Travis County Commissioners Court reinstating the ban for the County. More dry weather ahead it appears.

Also, KXAN did a story on the historic cabin that has been moved to the City Hall area. This is a great project and it's a piece of history the area should be proud of. Here is a link to the story and video!

Here are two press releases from LCRA - Release 1 deals with the sale of the West Travis Co. Regional Water and Wastewater Systems by LCRA to a group called the PUA, Release 2 is about the public review process for proposed revisions to LCRA's Water Management Plan.
Shannon Burk met with the Serene Hills Developer and his engineer to discuss the possibility of an alley to avoid having driveways onto Serene Hills Dr. There are engineering challenges and are putting together a proposal for some pull-off space in front of the houses.
There was a District Court Hearing Tuesday before Judge Sulak on the North Brooks Hollow annexation lawsuit. Judge Sulak declined to rule on the plaintiff's injunction request and will try to give a decision on another issue within the next few weeks.
It appears there will be a Special Council meeting Jan. 24 to authorize the sale of Library Bonds. It is not finalized yet.
Some of the rough cut planks on the Liebelt cabin were not reusable and new ones have been ordered. As soon as they are installed, shingles will be re-installed - probably next week. The City is working to solve some issues including locating period correct hardware for doors and windows so the cabin can be closed in as soon as possible.

Activity Picking Up! Texting Video
Most of you probably know that I have gone back to work contracting to AT&T training new technicians - it's fun! I have been doing some Safety that includes defensive driving and came across this video produced by AT&T on texting. If you have a few minutes, click on this link and watch it, be sure to send it to your kids - it is very moving!
ZAPCO met in regular session Wednesday. Here is that agenda. Several signs were approved and LTISD was told their recent signage was not considered an official notice and they would need to either remove the signs or obtain a variance. I expect to see that on the next agenda.
Several SUP's for Model Homes were recommended to Council and signs for those were also approved.
There was a presentation by the Lakeway Regional Medical Center regarding future development plans and was fairly well received. There were questions on a proposed apartment complex. The same presentation will be held at next Tuesday's Council Meeting - try to be there and see it!
Staff has been working on an ordinance because of an issue where a resident is driving on the grass around his home to park in the back yard that is an issue for a neighbor - his lights shine directly in their home and he has damaged their sprinkler system more than once. So far the solution is to prohibit driving across residential property except on a paved driveway. This will also come to Council Tuesday.
Since I am unable to attend these meetings, Council Member Wallace has volunteered to attend these meetings an report the outcome to me for the blog. Thanks Dennis!
CBC met Thursday, here is that agenda. A variance was granted at 102 Acapulco Dr. to allow a fence to partially encroach into the street-side setback along Morning Cloud. The variance for an encroachment at 322 Bisset Court was denied.
All other items were approved.

Per the Bee Cave Bee "Bee Cave and Lakeway both saw November 2011 Sales Tax rise around 12% above the same month in 2010. Bee Cave rose from $497,000 to $555,000, Lakeway from $154,000 to $172,000. State wide increases averaged 9.5% and Austin City saw a 6.2% rise."

Todd Radford reported that our officers responded to a burglary of a vehicle this morning on White Magnolia. They are still working on the details of the case, however an arrest of a subject was made shortly after the crime was committed. Apparently the victim saw the suspect in her vehicle and one of our officers found him in the area a short time later.
Chief Radford also gave3 a great presentation regarding the police department to the Men's Breakfast Club this week. We are going to try to have Todd repeat this for Council at the February meeting.
There is some interest being shown in the property owned by WCID #17 that is zoned multifamily. The interested party would use the property for apartments. Since it is on Hwy. 71, it is probably the least controversial location in the City for apartments.
There is preliminary hearing scheduled next Tuesday in the Brooks Hollow lawsuit. We anticipate a ruling on some issues in a couple of weeks.

Weekly Update

Monday night the City of Lakeway's Arts Committee Presents Lakeway Big Band Bash - Featuring The Republic of Texas Band. Doors open at 7:30 at the Activity Center.
ZAPCO will meet on January 11, 2012 at 9:10AM in regular session. Here is that agenda. There are several sign requests along with some model home SUP's.
There will be a presentation by the Lakeway Regional Medical Center regarding future development plans for the Center.
There is a Code Amendment being presented to restrict residents from driving on their lawns - this amendment is precipitated by an issue with a resident driving around the side of his house repeatedly and causing issues with a neighbor. Should be an interesting discussion.
The City Building Commission will meet next week on January 12, 2012 at 9:00AM in regular session. Here is that agenda. Looks like there are 2 variance requests, both wanting to encroach into a street setback for a fence. There are a couple of height requests also. I bet they make lunch!

The City received a letter from the Lake Travis Community Library District Board of Trustees indicating they are ready to move forward with awarding a contract for constructing the Library. There will be an item on the January 17th agenda authorizing the city's financial advisors to bid out the bonds for this project with the goal of awarding the sale at our Feb. meeting. A Special Council Meeting may be required to award the bid before it expires.
Code enforcement has been active in our newly annexed areas. They are looking into the legality of a masonry fence being constructed without a permit in Brooks Hollow - there is a question as to whether it is grandfathered or not. They have also begun procedures to have an abandoned house on Kohlers Trail in Travis Oaks Trails to have the home repaired or removed.
The solid waste department held a meeting this week with our partners (WCID 17 and the Village of The Hills) in the annual household hazardous waste collection program. We are looking into the possibility of locating a “permanent” site that could be available to our residents on a regular (quarterly or monthly) basis. We are investigating the cost. We believe we may be close to being able to provide this service at the same cost as our current annual program due to the flexibility and efficiency of a permanent facility.
Jim Swift, human-interest reporter for KXAN, came to city hall today to produce a story on the Liebelt Cabin. He spent a couple of hours interviewing several of us and filming the worksite. Mr. Swift does not know when the story will air but said that he would try to give us advance notice. I will let you know if I find out in time. It should be an interesting story. Mike Boston took a great deal of time talking to him about the history of the cabin and our area.
State Climatologist, John Nielsen-Gammon will talk about the Texas drought at a meeting sponsored by the Central Texas Water Coalition on January 12th at Carlos' N Charlie's. Click here for details.
Public Works reports that:
•Yesterday was the last “First Thursday” until July for disposal of oak trimmings. There was an above average amount of brush hauled to the disposal site Thursday.
•Many Christmas trees have already been dropped off and chipped. Part of our crew has been busy this week just managing the accumulating brush and Christmas trees.
•Dale Delong is making progress with our new street-sign management software and computer.
•We prepared one bay of our shop to receive the annual shipment of Lakeway telephone directories. They will be distributed tomorrow morning (Saturday).

Week Ahead News
Well, the City was really quiet last week, but it looks like it's picking up this week. At least things are happening in Lakeway!

You're Invited to the Activity Center Grand Re-opening on Friday, January 6th! We are welcoming the community to a grand re-opening party to celebrate a dramatic new makeover that has just been completed by Calming Spaces Interiors, Design & Remodeling at the Lakeway Activity Center, 105 Cross Creek Road, from 7 - 9 PM on Friday, January 6th. Entertainment will include live music, refreshments and door prizes.
Lake Travis Parade of Champions ~ Saturday January 7th - The Lake Travis Independent School District, the City of Bee Cave, and the Hill Country Galleria will kick off the New Year in grand style as together they recognize the largest number of students ever during the Lake Travis Parade of Champions. The LT community is invited to celebrate our historic five-time state champion Cavaliers football team, our record-setting two-time state champion Lady Cavs volleyball team, our 2011 state champion boys' golf team, our 2011 state runner-up girls' golf team, our state runner-up tennis team, our state finalist Mighty Cavalier Marching Band and our 2011 National Merit Scholarship Program honorees.
The festivities will begin with live music in the amphitheater prior to the parade. The parade will begin at 5:00 p.m. near Dillard's and conclude at the opposite end of the Galleria near Zinger's. A fireworks display will follow the awards ceremony. All visitors are asked to please park in the garages as Main Street will be closed during the festivities.
Lakeway Mayor’s Fitness Council 2012 Buddy Weight Loss Challenge Begins Monday, January 9th - The 2012 City of Lakeway sponsored Weight Loss Challenge will be a buddy (team) challenge. We have seen phenomenal results when husband/wife or friends join our challenges together. Team members can create healthy competition amongst themselves and also provide extra support on a daily basis. So, bring your spouse, neighbor, friend, relative or favorite hairstylist and join the Lakeway Mayor’s Fitness Council 2012 Buddy Weight Loss Challenge. If you do not have a buddy to bring, you can compete individually or team up with another person at the initial class. Prizes will be awarded to the teams who lose the largest percentage of weight relative to the team’s total weight. Classes will meet on Mondays beginning January 9th through March 26th from 6 - 7 PM at the Activity Center located at 105 Cross Creek. Special Reminder: City of Lakeway Burn Ban Lifted
The Travis County Commissioners Court voted on Tuesday, November 22 to temporarily lift the burn ban for Travis County. In accordance with that action, Mayor Dave DeOme officially lifted the City of Lakeway’s Burn Ban, effective November 23, 2011.

Blood Drive News
Every 8 weeks 80+ potential donors show up to donate blood which is collected by a team from the Blood Center of Central Texas. In 2009, 2010 and again in 2011 our Lakeway Drive was the largest Community Blood Drive in the 10 county area served by the Blood Center of Central Texas. Our next Lakeway Community Blood Drive will be held at the Lakeway Activity Center on Saturday, January 21 from 8:00 AM until 12:00 PM.
Donors must be at least 17 years of age, weighing at least 115 lbs, and be in generally good health. Donors should know their social security number and bring a photo ID. The process takes about 45 minutes to 1 hour.

You're Invited to the Activity Center Grand Re-opening on Friday, January 6th! We are welcoming the community to a grand re-opening party to celebrate a dramatic new makeover that has just been completed by Calming Spaces Interiors, Design & Remodeling at the Lakeway Activity Center, 105 Cross Creek Road, from 7 - 9 PM on Friday, January 6th. Entertainment will include live music, refreshments and door prizes.
Lake Travis Parade of Champions ~ Saturday January 7th - The Lake Travis Independent School District, the City of Bee Cave, and the Hill Country Galleria will kick off the New Year in grand style as together they recognize the largest number of students ever during the Lake Travis Parade of Champions. The LT community is invited to celebrate our historic five-time state champion Cavaliers football team, our record-setting two-time state champion Lady Cavs volleyball team, our 2011 state champion boys' golf team, our 2011 state runner-up girls' golf team, our state runner-up tennis team, our state finalist Mighty Cavalier Marching Band and our 2011 National Merit Scholarship Program honorees.
The festivities will begin with live music in the amphitheater prior to the parade. The parade will begin at 5:00 p.m. near Dillard's and conclude at the opposite end of the Galleria near Zinger's. A fireworks display will follow the awards ceremony. All visitors are asked to please park in the garages as Main Street will be closed during the festivities.
Lakeway Mayor’s Fitness Council 2012 Buddy Weight Loss Challenge Begins Monday, January 9th - The 2012 City of Lakeway sponsored Weight Loss Challenge will be a buddy (team) challenge. We have seen phenomenal results when husband/wife or friends join our challenges together. Team members can create healthy competition amongst themselves and also provide extra support on a daily basis. So, bring your spouse, neighbor, friend, relative or favorite hairstylist and join the Lakeway Mayor’s Fitness Council 2012 Buddy Weight Loss Challenge. If you do not have a buddy to bring, you can compete individually or team up with another person at the initial class. Prizes will be awarded to the teams who lose the largest percentage of weight relative to the team’s total weight. Classes will meet on Mondays beginning January 9th through March 26th from 6 - 7 PM at the Activity Center located at 105 Cross Creek. This is a nutrition and healthy lifestyle class, not an exercise class. Cost for the entire series of classes is $30. Please call 261-1010 today to join!

The City of Lakeway can now send quarterly solid waste bills electronically! This convenient method allows you to reduce paper waste and help the local environment. Electronic notifications are sent 1 to 2 days earlier than the paper bill.
Special Reminder: City of Lakeway Burn Ban Lifted
The Travis County Commissioners Court voted on Tuesday, November 22 to temporarily lift the burn ban for Travis County. In accordance with that action, Mayor Dave DeOme officially lifted the City of Lakeway’s Burn Ban, effective November 23, 2011.
