Memorial Day Program, Weeks News and More!

Don't forget the Memorial Day Program at Heritage Center, it starts at 10AM on Monday May 28th.  One thing about Lakeway, it's the most Patriotic City I know of - I hope you will come and honor our hero's.  Here is a link to more information.

Lakeway's Big Band Bash was professionally filmed on May 14 for inclusion in a documentary on ballroom dancing in Central Texas to be premiered at the next SXSW Film Festival.  Thanks Fred!

Our Household Hazardous Waste grant was approved by committee and is recommended for approval by Capital Area Council of Governments and the Texas Commission on Environmental Quality.  The amount approved was $87,358, and will be a real help to establishing a permanent home for the HHW program.

We received news this week that the appellant in the North Brooks Hollow annexation lawsuit filed their brief with the appeals court this week.  Our attorneys now have 30 days to file our response, and then we will wait for the court to take action.

Recovery Ways has sent a letter appealing the denial of a permit and also the decision by ZAPCO and City Council to the Board of Adjustment.  The appeal was filed too late to enable the BOA to meet on the denial of permit (30 day limitation) and the BOA has no jurisdiction on City Council Decisions.

The City's Financial Advisor is working on refunding a portion of the city's outstanding general obligation bonds to take advantage of the currently favorable bond market.  There is a possible savings of about $300,000 over the life of the bonds.

Chief Radford and Lt. Ken Farr taught an anti-drug course for the 5th graders in the LTISD system.  The reviews have been very favorable!

Council Update - Council Members Sworn In

Council met in regular session last evening.  Here is that agenda.

A financial report was made by Assistant Treasurer George Kimes.  He reports that we are above budget on income and below budget on expenses, what a GREAT thing!  We actually are about $700K to the good so far this year.

May 25th was proclaimed "National Missing Children's Day" in Lakeway.  Hundreds of thousands of children are reported missing each year in the U.S., it's a staggering number!  Police Chief Todd Radford asked that everyone take 25 minutes of their time on Friday the 25th to talk to a child about security and safety - I think that's a good idea!

A resolution was passed canvassing the returns and declaring the results of the General Election and the Special Election.  Here is the resolution.  Bruce Harris, Dave Taylor and Dee Ann Burns-Farrell were re-elected to the City Council for another term.  Both Propositions to sell parts of Rebel and Sailfish parks failed.

The newly elected Council Members were then sworn in by Judge Kevin Madison and congratulated by the audience with a round of applause!

Council Member Joe Bain was appointed Mayor Pro Tem for the next 12 months.  Thank you to all the Council Members and Mayor for your support!

The City of Lakeway Investment Policy was amended to extend the time limit allowed on maturing investment CD's from 12 months to 16 months.  This will allow City investments to take advantage of more options.

A Lakeway Visitors Commission was established to promote tourism and provide oversight of the hotel occupancy tax.  The Commission will include 7 members, 3 guaranteed representing the hotels in Lakeway. 

A resolution was passed supporting the timely approval of the Lower Colorado River Authority's 2012 Water Management Plan by the TCEQ.

The first reading of the Annexation Plan for Lakeway Highlands Phase 2 Section 2 was held.

Item 13 was a replat of "Fox Creek Estates" a subdivision in the City's ETJ.  Although three residents of the subdivision spoke against the replat and one of those residents has already filed a lawsuit against the City, the replat was approved.  No matter which way this went the residents still retain all their rights to oppose this replat through the courts between themselves.  The City was in a no-win situation on this issue and if they would have denied the replat, would have been forced to approve it eventually.

Item 14 was a request for a zoning change to C-1for  15100 Gebron Dr.  This property was annexed recently and zoned R-6.  It was in the middle of a residential area and had been for some time.  Council was uneasy about approving full C-1 zoning and denied the request, but instructed staff to work out a letter to further define what would be permitted as a "Grandfathered" entity.

The Consent agenda was approved, item 18 was pulled by Dennis Wallace.

Item 18 was the appointment of Lori Nines to the Board of Ethics by Council Member Wallace.  He introduced Mrs. Nines to the Council and her appointment was approved unanimously!  Congratulations Mrs. Nines!


Chief Radford also reported that Officer Slade Fisher went home from the hospital Sunday afternoon.  He was seriously injured while trying to apprehend a vehicle trying to escape a traffic stop.  We are excited that he is doing well at home and look forward to his complete recovery!

Council Member Taylor requested the City and Council look into ways to improve the enforcement of Election Regulations at future City Elections - especially during early voting at Randall's in Lakeway. 

Council Member Tye requested the City investigate the possibility of using the same technology to stream the Council Meetings live via the internet.

Big Week!

 One of our finest was injured in an accident during an attempted stop of a vehicle 5-17-2012, you might have seen the incident on TV.  Officer Slade Fisher was on patrol on his police motorcycle and lost control following an auto that was fleeing.  He was severely injured on Highland Parkway and was flown to Brackenridge Hospital by helicopter.  At last report today, he was doing better and was in surgery.  Please put him in your thoughts and prayers, our officers risk their lives daily to keep us safe!

Recovery Ways Update - Our TML insurance will accept our claim on Recovery Ways.  This means they will represent us in any court or legal claims.  There has been no lawsuit filed at this point but they are filing a motion to depose some staff.

There is a Memorial Day Ceremony scheduled for Monday, May 28th at the Lakeway Heritage Center.  Please join us to honor those that have died serving our country!  Here is a link to more information!

Two major events are happening this Saturday!  The City-Wide Indoor Garage Sale is going on at the Activity Center from 8AM until noon.  Here is more info.  There will also be a Hazardous Waste Collection & Document Shred Event going on from 8AM until noon at the Hudson Bend Middle School.  This is put on in conjunction with the Hurst Creek MUD, The Village of The Hills. Lakeway MUD, City of Bee Cave and WCID #17, is hosting a Household Hazardous Waste Collection and Document Shred event, this Saturday, May 19, from 8 a.m. to 12 noon, at Hudson Bend Middle School (15600 Lariat Trail at RR 620 and General Williamson Rd).  This link will get you more info.

Lakeway is of course getting ready for the annual Fourth of July Celebration.  Here is a link to a summary of events so you can get them on your calendar - I will post this and more again closer to the event!

City Building Commission will meet in regular session next week on May 24, 2012.  Here is that agenda.

City Council will meet in regular session Monday, May 21, 2012 at Council Chambers.  Here is that agenda.  Come congratulate the incumbents on their re-election to their Council positions.  They will be sworn in by Judge Madison for their two year terms.  It will start at 6:30PM - see you there!  Interested in the information in Council Notebooks?  Here it is, we are posting it on the City website.

Staff met this week with representatives of the Medical Village development.  They are ready to submit an updated application for an assisted living facility at the hospital campus - they will also submit an updated plan that reflects some revisions since the original plan was approved - no surprises are anticipated.

Recovery Ways filed an appeal with the Board of Adjustment to overturn ZAPCO's and Council's decision to disapprove their special use permit.  The 30 day deadline on ZAPCO's decision has lapsed and the Board of Adjustment has no authority to hear an appeal of Council's decision.

The first meeting of the Explorer Program was held and there are 7 kids involved in the program - We are Post 620!

Election Results! Just in!

Here are the election results - this comes from the Travis county Website and all 7 precincts are reporting.

These are the numbers with all 7 precincts in:

Anita Cokins                      886 votes with 19.23 %
Bruce Harris                       1,134 votes with 24.61 %
Dave Taylor                        1,117 votes with 24.24%
Dee Ann Burns-Farrell      910 votes with 19.75 %
Kay Sconci                         561 votes with 12.17 %

Prop 1                                   773 votes with 41.92 % - FOR
                                                1,071 votes with 58.08 % - AGAINST
Prop 2                                   764 votes with 41.30 % - FOR
                                                1,086 votes with 58.70 % - AGAINST

Congratulations to Bruce, Dave and Dee Ann!

The Lakeway M.U.D Board came out with Tom Brewer, Mel Neese and Kay Andrews winning seats.  Congratulations!

Week's News - Plus More on Your City! Another Editorial (sorry)

Let's start with the weeks happenings.

ZAPCO meet in regulars session May 2, 2012.  Here is the agenda with the results of the votes - thanks Chessie!  ZAPCO is the Zoning and Planning Commission, there are 7 members plus alternates, they meet monthly on all types of zoning and planning issues and are all volunteers.

CBC (City Building Commission) will meet May 10th.  Here is that agenda.  The Building Commission meets twice a month and looks at requested variances and waivers plus inspects new homes and remodels to insure compliance with ordinances.  The commission is made up of 7 members and alternates and are all volunteers.

City Staff met with the Lakeway Medical Village Developers Monday to discuss the eminent completion of Flint Rock Trace and 620 improvements and also looked at additional development and building issues.  There will be preliminary plans in the very near future.

From Chief Todd Radford:
1.  There were several officers in Basic TCLEOSE instructors school.
2.  We are working on a server upgrade project that will improve functionality.
3.  The LPD Color Guard presented the flags at the National Day of Prayer ceremony at the Activity Center on May 3.
4.  The final tally for the drug tack back program and 337 lbs. of medications were collected!

Congratulations to Julie Oakley and her staff!  For the 3rd year in a row, the City has been awarded the highest level (gold) award by the State Comptrollers office.  According to their website, this award identifies "entities that are setting the bar with their transparency efforts".

The process is starting on the FY 2013 budget.  Here is a link to scheduled meetings.

Now more City Info.  I have been bombarded with election flyers and letters - most saying the City is not concerned with children and parks.  Thank you to Andra Dearing for collecting this info.  Here is a list of current parkland and amenities the City provides to residents, those with (GS) are considered Green Space and are currently undeveloped:

As you can see, the City and its elected officials are very interested in providing facilities for residents.

I also would like to see ball parks and larger facilities for our youth - consider, it sounds good, but large land purchases (if available) inside the confined City Limits would be VERY expensive, almost impossible.  I have spoken with County Officials and would like to get Travis County involved in more facilities.  Their money has been spent on land purchases of late and none are currently being developed. Do we need to improve our facilities?  Of course!  Do we need to do this in a responsible manner?  You bet!

---------- Editorial ----------

Think about what is being said, and the sources.  Much is coming from individuals that have only lived in our fair City for a few months yet have been availing themselves of the available facilities and parkland for years without supporting them by paying property taxes!

When I was first introduced to Lakeway (my Aunt had a house here in 1971) the demographics were substantially different.  95% of the residents were retired and it was considered an upscale retirement community.  As the demographics changed, our City has adapted to support the growing and significantly younger population, trying to represent those folks moving in in droves.  The current Council continues to try to represent ALL of the citizens of Lakeway.

I keep seeing references to "illegal" annexations - once again, the complainant's lawsuit was dismissed at a Summary Judgment hearing - more than $70,000 billed to the residents?  I'm not sure where this figure comes from, but not from our checkbook.  And remember, the City is defending itself, we did not file the lawsuit!  It appears this is the ultimate issue for one of the candidates.

Once again, as far as Recovery Ways is concerned, once Council found out what was going in, they made rapid decisions that stopped this from happening.  They then made corrections to current ordinances to keep this same situation from happening again.  The original application was written to conform to the C-1 ordinance, maybe not in the best interest of our City.

Does Council and Senior Staff look at every business application in the City?  No, 200-300 applications are received every year and our ordinances handle almost all of them properly.  Was there an issue on this one?   Maybe, but it's fixed now.

Currently, Recovery Ways has sold the initial property and may have lost the money it used for land preparation.  The high figure I hear quoted includes monies they claim to have lost because they are not open and making money.  It also includes building plans that they can use if they decide to locate somewhere else.

I started writing this blog to try to give as much information to the community as I could.  You can bet if I know about it and can talk about it (legal and personnel issues have some restrictions), its in my blog.  I am becoming offended at the attacks directed to our current Council.  I personally voted in favor of the unilateral annexation of both North Brooks Hollow and Travis Oaks Trails because I felt it was in the best interest of ALL of the citizens of Lakeway.

There are recordings of all of the annexation public hearings on the City website.  Feel free to listen to these, it might surprise you as to the statements of some of the "candidates" issues.  Turns out Austin Police made a bust in North Brooks Hollow.
